The problem with the Animal Welfare Act is an amendment attached to it in 2002 that could be an illegal "bill of attainder." This is legislation that declares an entire class of guilty without a fair trial. The Constitution forbids such things. Was the so-called Helms Amendment to the Animal Welfare Act--which banned animals like birds, rats, and mice from protection--a "bill of attainder"? PETA Foundation attorney Asher Smith thinks so and has filed a federal lawsuit that could end the cruel use of thousands of animals used in experimentation.
